(collectively, "Company," "we," "us," or "our") respects your privacy and is committed to protecting the personal information of individuals who visit our website or use our mobile application(s) (collectively, the "Services"). To the extent permitted by applicable law, by accessing our Services, you acknowledge that you have read, understood, and or consent to the practices described in this Privacy Policy.

This Privacy Policy does not apply to any information, including personal information, that you provide using any such features. All such information is public information and may be viewed, collected, used, modified, and or disclosed for any purpose by us and the public.

Please note that no security measures are perfect or impenetrable, and no transmission over the internet or electronic storage is 100 percent secure or error-free. In particular, email sent to or from the website or communications using the mobile app may not be secure, and you should therefore take special care in deciding what information you send to us by email or other electronic means.

We therefore cannot guarantee and do not warrant the absolute security of your personal information. We retain your personal information for no longer than reasonably necessary to fulfill the purposes for which we collected it or to comply with the law, prevent fraud, facilitate an investigation, defend against legal claims, or exercise our legal rights.

V. Additional Information

a. Opt-Out from Communications

We may use your email address or other personal information to send you promotional materials. You can opt out of receiving promotional communications by following links provided in the messages, by updating your account preferences through the Services, or by contacting us directly at [email protected].

Although your request to stop receiving information will be reflected promptly in our database, we may retain all information you submit for a variety of purposes, including backups and archiving, prevention of fraud and abuse, and analytics or statistics about our users. In order to fulfill your requests, we may require additional information from you. You may decline to share certain information with us, in which case we may not be able to accept your membership or provide you with our Services.

We cannot offer any assurances as to whether the companies we work with participate in the opt-out programs described above.

b. Your Privacy Rights

Depending on your jurisdiction, you may have certain rights regarding your personal information, including the right to:

  • Access your personal information
  • Request correction of inaccurate information
  • Request deletion of personal information
  • Withdraw consent where processing is based on consent

c. Account deletion

You may request deletion of your account through the account settings available in our mobile application(s) or, if you are unable to access the app, through our account deletion webpage at https://biciclub.app/delete-account. When you request account deletion, we will disable access to your account immediately and begin deleting or anonymizing the personal information associated with your account. We may retain limited information where necessary to comply with law, prevent fraud or abuse, resolve disputes, enforce our agreements, maintain security, or preserve the integrity of certain service records. For example, if you participated in a club, event, notice, message, or similar activity through the Services, some related records may remain in our systems in anonymized form so that the Services and related historical records continue to function properly. In such cases, those records will no longer identify you as an active account holder and may appear as "Deleted User" or a similar label. Final cleanup of account deletion requests is generally completed within 7 days of the request, unless a longer period is required by law or for a legitimate business purpose described in this Privacy Policy.

d. Data Retention

We retain information as long as it is reasonably necessary to provide our Services, and for other purposes including to comply with the law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigation, or enforce our Terms or other agreements. If you request deletion of your account, we will process that request as described in Section V.c (Account deletion), including deleting or anonymizing personal information and retaining limited information only where permitted or required for legitimate purposes.

e. Children

We do not knowingly collect or maintain information directly from persons under 13 years of age ("Children"), and no part of the Services is directed to Children. If you are under 13 years of age, please do not use or access the Services at any time or in any manner.

If we become aware that we have collected personal information from Children without appropriate consent, we will take appropriate steps to delete this information. If you are a parent or guardian and discover that your child has provided us with personal information without your consent, please contact us using the contact information below to request deletion of that information from our systems.

f. International Data Transfers

Your personal information may be transferred to and processed in jurisdictions outside your province, state, or country where privacy laws may differ. If you use the Company's Services from outside Canada, you acknowledge that your personal information may be transferred to or accessed from Canada, and consent to such transfer or access.

g. Notice to California Residents

Pursuant to Section 1798.83 of the California Civil Code, California residents have the right to obtain certain information about the types of personal information that companies with whom they have an established business relationship, and that are not otherwise exempt, have shared with third parties for direct marketing purposes during the preceding calendar year.

h. Nevada Privacy Rights

If you are a resident of Nevada, you have the right to opt out of the sale of certain personal information to third parties. You can exercise this right by contacting us at [email protected] with the subject line "Nevada Do Not Sell Request" and providing us with your name and the email address associated with your account. Please note that we do not currently sell personal information as sales are defined in Nevada Revised Statutes Chapter 603A.

i. Limitation of Liability

By accessing the Services and or providing us with personal information and other data, you expressly and unconditionally release and hold us harmless from any and all liability for any injuries, loss, or damage of any kind arising from or in connection with the use and or misuse of such information.

k. Updates to This Privacy Policy

This Privacy Policy is effective as of the date stated at the top of this Privacy Policy. We may update or make other changes to this Privacy Policy from time to time, without notice. We will notify you about changes that significantly impact our use of your personal information by placing a prominent notice on our website or mobile application(s) or by sending you an email.

We recommend revisiting this page periodically to make sure that you have the most recent information regarding our collection and use of your personal information. To the extent permitted under applicable law, your use of our Services after an update reflects your consent to the practices described in this Privacy Policy.

For the avoidance of doubt, disputes arising as considered in this document will be resolved in accordance with the Privacy Policy in effect at the time the dispute arose.

l. Governing Law and Jurisdiction

This Privacy Policy and any disputes arising out of or relating to it, including any dispute concerning the collection, use, disclosure, or protection of personal information, shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

You agree that any legal action or proceeding arising out of or relating to this Privacy Policy shall be brought exclusively in the courts of the Province of Ontario, and you hereby irrevocably submit to the jurisdiction of those courts.
